The Ukrainian National Lobbyists Association calls on the NACP to coordinate clarifications of the law with the professional community
The Ukrainian National Lobbyists Associationwelcomes the publication by the National Agency for the Prevention of Corruption of clarifications on the application of certain provisions of the Law of Ukraine “On Lobbying”.
We positively assess any steps aimed at establishing a unified practice of applying lobbying legislation and increasing legal certainty for all participants in the process.
At the same time, the Ukrainian National Lobbyists Association emphasizes that the preparation and publication of clarifications to the relevant legislation should be carried out exclusively with the involvement of the professional community and after a preliminary public discussion with practicing lobbyists.
Lobbying is a new professional field for Ukraine, and therefore any official interpretation of the law without taking into account the practical experience of lobbying entities may lead to ambiguous application of the law, create additional barriers to professional activity and harm the process of establishing the profession.
The Ukrainian National Lobbyists Association, as a leading professional association and representative of the lobbying community, calls on the NACP to refrain from further issuing clarifications to the Law of Ukraine “On Lobbying” without prior consultation with the professional community and its official representatives.
We are convinced that only an ongoing dialogue between the regulator and practicing lobbyists will allow us to develop clear, high-quality and effective mechanisms for implementing the law that will meet both the interests of the state and the needs of the professional community.
The Ukrainian National Lobbyists Association confirms its readiness to contribute to the preparation of future methodological materials, recommendations and clarifications in order to form a sustainable and predictable practice of applying lobbying legislation.
Professional regulation should be formed together with the professional community.
